What is a Factory ACT?

The factory act 1934 was passed in order to replace all the previous legislation that was in regard to factories. Its functioning had revealed a number of defects and weaknesses that had hampered the effective administration of the act. This demanded the revision of the act for extending its protective provisions. Then came the Factories Act 1948 that received the assent of the Governor-General of India.

The objectives of the act were:

  • Working hours

As per the provision of working hours of adults, none of the adult workers shall be required to work in a factory for more than 48 hours a week with a weekly holiday.

  • Health

For the protection of the health of the workers, the act has laid down that every factory should be clean and necessary precautions should be taken in this regard. There must be a proper drainage system, lighting, ventilation, and temperature. Other than this, proper arrangements for drinking water should be there with sufficient latrine and urinals places.

  • Safety

For providing safety to the workers, the Factory Act states that the machinery should be fenced, none of the young persons must be appointed for unsafe machines. Also, there must be provision for manholes of the proper size so that the workers can escape at the time of emergency.

  • Welfare

For ensuring the welfare of the workers, the act states that there must be suitable facilities for washing. Furthermore, there must be space for storing, dry clothing, sitting, first-aid appliances, shelter, restrooms, lunchrooms, etc.

Importance of The Act

The objective behind the establishment of the Factory ACT Compliance in Gurgaon is to safeguard the interest of the workers, stop exploitation, and take care of things like safety, hygiene, and welfare. It also puts various obligations, duties, and responsibilities on the shoulders of the occupier of the factory and on the manager.
